The 11-month rent agreement is one of the most widely used — and most misunderstood — legal documents in India. Here is what the 11-month convention actually means, what it saves you, what it costs you, and the clauses that decide disputes when they happen.

Why 11 Months?

Under Section 17 of the Registration Act, 1908, a lease of immovable property for a term of one year or more must be registered with the Sub-Registrar. Registration means stamp duty on the full term, registration fees and a visit to the Sub-Registrar office. An 11-month agreement stays below that threshold — it can be executed on stamp paper without compulsory registration, which is why the convention exists.

The trade-off: an unregistered agreement is weaker evidence in court, and in many states an unregistered lease is admissible only for limited purposes. Stamp Duty: State by State

Stamp duty on rent agreements is a state subject and varies widely — typically calculated as a percentage of the average annual rent. In Uttar Pradesh and Delhi, 11-month agreements are commonly executed on stamp paper of nominal value, while Maharashtra mandates online e-registration of leave-and-licence agreements regardless of term. Using the wrong stamp value does not void the agreement, but it becomes inadmissible as evidence until the deficit (with penalty) is paid — an expensive surprise mid-dispute.
